2. Scope of These Terms

These Terms apply to your use of Spark Security Store and to orders placed through sparksecuritystore.co.uk.

We supply both:

• Consumers / Public customers purchasing mainly for personal use; and
• Trade / Business customers purchasing wholly or mainly for business, trade or professional use.

Where consumer protection legislation gives a consumer rights that cannot legally be restricted or excluded, those statutory rights take priority over any inconsistent provision in these Terms.

3. Orders & Contract Formation

When you place an order, you are making an offer to purchase the products shown in your order.

Receipt of an automated order acknowledgement does not necessarily mean that we have accepted the order.

An order may be subject to:

• Product and supplier availability.
• Successful payment or payment authorisation.
• Fraud and security checks.
• Delivery-area availability.
• Verification of obvious pricing or listing errors.

Where we cannot accept or fulfil an order after payment has been taken, we will arrange an appropriate refund for the affected item or order.

4. Product Information & Compatibility

We take reasonable care to ensure product descriptions, specifications, photographs and other information are accurate.

Product images are illustrative and packaging, appearance or minor specifications may change where manufacturers update their products.

Customers are responsible for checking that a product is suitable and compatible with the intended system or application before ordering.

If you are uncertain about compatibility, please contact our product team before placing your order.

5. Prices & Trade Pricing

Prices displayed by Spark Security Store are shown in GBP.

Spark Security Solutions Limited is currently not VAT registered. Prices charged to customers are therefore the final product prices shown by the Store, together with any applicable delivery charges or other clearly disclosed charges.

Approved Trade Accounts may receive different pricing from Public customers. Trade pricing may vary by product, quantity, supplier cost and commercial terms.

A Trade Account does not guarantee a fixed percentage discount across every product.

If an obvious pricing or product-listing error is identified before an order is accepted, we may contact you to confirm whether you wish to proceed at the correct price or cancel the affected order.

6. Payments

Available payment methods are displayed during checkout.

Payment may be processed by an authorised third-party payment provider. Payment is subject to authorisation and applicable security checks.

We do not require access to your complete card details to process normal card payments.

An order may be cancelled where payment is declined, reversed, suspected to be fraudulent or otherwise cannot be completed.

7. Delivery

Spark Security Store operates primarily as an online retailer.

Standard delivery is currently £9.50, with free standard delivery on qualifying orders over £200 to eligible mainland destinations in England, Scotland and Wales.

Remote areas, islands, oversized products, specialist deliveries or certain supplier-direct shipments may have different charges or restrictions.

Any additional delivery charge that applies to an order will be communicated or displayed before the affected order is completed where required.

Delivery dates and lead times are estimates unless we expressly agree otherwise.

8. Supplier-Direct Delivery

Spark Security Store may fulfil products directly from a supplier, distributor or third-party warehouse.

This means products within the same order may sometimes arrive separately or from different delivery partners.

Supplier-direct fulfilment does not change the identity of the retailer from whom you purchased the goods. Your contract remains with Spark Security Store unless we expressly state otherwise.

9. Order on Request & Special Order Products

Order on Request

Products identified as Order on Request may not be held in immediately available stock and may need to be obtained from a supplier following your order.

Availability and lead times may therefore require supplier confirmation.

If an Order on Request product cannot be supplied, we will contact you and, where appropriate, cancel and refund the affected product.

Special Order / Bespoke Products

Certain products may be specially manufactured, configured, personalised or obtained specifically to customer requirements.

Different cancellation rules may apply to genuinely bespoke or personalised products where permitted by law. Any relevant restriction should be made clear before the order is completed.

Trade / Business Customers

For Trade and business customers, products specifically obtained against the customer’s order and identified as Order on Request or Special Order are normally non-returnable for change of mind once the order has been accepted and committed to the supplier, unless Spark Security Store agrees otherwise in writing.

This does not remove rights or remedies that cannot lawfully be excluded, including appropriate remedies where goods are faulty or incorrectly supplied.

10. Consumer Online Cancellation Rights

Consumers purchasing qualifying products online generally have a statutory right to cancel without giving a reason.

For qualifying goods, the cancellation period normally ends 14 days after the consumer receives the goods. After notifying us of cancellation, the goods must normally be returned within the applicable statutory return period.

Exceptions can apply, including to certain genuinely personalised or custom-made products and other categories excluded by applicable legislation.

11. Faulty, Damaged or Incorrect Products

If you receive a product that is faulty, damaged, incorrect or not as described, please contact us as soon as reasonably possible.

Consumer customers retain their statutory rights, including applicable rights under the Consumer Rights Act 2015.

Manufacturer warranties may provide additional protection but do not replace statutory consumer rights.

Please contact Spark Security Store before returning goods so we can provide the appropriate return instructions.

12. Returns & Refunds

Return eligibility depends on the type of customer, reason for return, product and applicable legal rights.

Consumers and Trade customers may therefore have different return arrangements.

Please read our Refund & Returns Policy before returning a product.

Do not return products directly to a manufacturer, supplier or distributor unless Spark Security Store has instructed you to do so.

13. Installation & Product Use

Some electrical, security, fire, access-control, networking and related products may require competent or professional installation.

Customers are responsible for ensuring that products are installed and used appropriately and in accordance with manufacturer instructions and applicable requirements.

Spark Security Store’s sale of a product does not automatically include installation.

Where installation services are separately provided by Spark Security Solutions, those services may be subject to separate quotations, terms and service arrangements.

14. Trade Accounts

Trade Accounts are intended for eligible professional, business and trade customers.

Trade Account applications may be reviewed before approval.

We may amend or withdraw Trade pricing or account privileges where reasonably necessary.

Trade pricing may differ between products and does not represent a guaranteed fixed discount.

A Trade customer purchasing wholly or mainly for business purposes may not have the same cancellation rights as a consumer.

15. Customer Accounts & Website Use

Customers are responsible for keeping account login information secure and for providing accurate account, billing and delivery information.

You must not misuse our website, including by:

• Attempting unauthorised access.
• Introducing malicious software.
• Interfering with website security.
• Using the website for unlawful purposes.
• Misusing or copying protected website content.

We may restrict account or website access where we reasonably believe misuse, fraud or a serious breach of these Terms has occurred.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing is intended to exclude statutory consumer rights relating to goods that are faulty, not as described or otherwise fail to meet applicable legal requirements.

Business Customers

To the extent permitted by law, we will not be liable to a business customer for indirect or consequential business losses, including loss of profit, revenue, business opportunity or goodwill arising from a product purchase.

Any limitation in these Terms applies only to the extent permitted by applicable law.

17. Intellectual Property

Website content, branding, graphics, text and other materials are owned by or licensed to Spark Security Store or Spark Security Solutions Limited unless otherwise stated.

Manufacturer names, trademarks and product imagery may belong to their respective owners.

Content may not be copied, reproduced or commercially redistributed without appropriate permission except where permitted by law.

18. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events genuinely outside our reasonable control.

These may include severe weather, transport disruption, supplier disruption, utility or network failures, industrial action or other exceptional events.

Where an event affects an order, we will take reasonable steps to minimise disruption and communicate with the customer where appropriate.

19. Privacy & Personal Information

Personal information is processed in accordance with our Privacy Policy .

Order information may need to be shared with appropriate suppliers, fulfilment providers or couriers where necessary to complete supplier-direct delivery.

20. Changes to These Terms

We may update these Terms when our services, business model or applicable requirements change.

The latest version will be published on this page with an updated revision date.

The terms applicable when an order was placed will normally govern that particular order, subject to applicable law.

21. Governing Law

These Terms are governed by the laws of England and Wales.

Consumers retain any applicable rights regarding the courts in which they may bring proceedings.

For business customers, subject to any mandatory legal requirements, the courts of England and Wales shall have jurisdiction in relation to disputes arising from these Terms or an order.
